These Terms and Conditions, together with the privacy policy will govern your membership with Sophie Walker, Attentive Art and Calm Creative Club. Please also see the Privacy Policy, Terms of Website Use and Terms of Purchase which will govern your use of this website.

Membership of Calm Creative Club

Membership Details

When you sign up for Calm Creative Club, you consent to having read and understood these Terms and Conditions.

On acceptance of the membership application by Sophie Walker and Attentive Art, Members shall be bound during the continuance of membership by these Terms and Conditions including any amendments made in accordance with the procedure set out below.

Attentive Art reserves the right at all times and in its absolute discretion to determine the number of Members in Calm Creative Club and may accept or reject applications for membership as it feels fit.

The monthly membership fee for Calm Creative Club is £10.00 (GBP) this is not in any way affected if other currency values fluctuate. Sophie Walker and Attentive Art reserve the right to alter the membership fee at any time, in this event, you will be notified beforehand and given the option to stay or not.

Membership is on a rolling month by month basis. Membership is to be paid on the same day of each month from the date which you signed up. Failure to pay membership on time may result in termination of membership.

All membership monies are payable in sterling, with a credit or debit card. Attentive Art uses a secure payment method. Membership fees are revised annually but providing your membership is continuous the payment you make may remain the same as on joining.

Terminating Membership

Sophie Walker and Attentive Art reserve the right to expel Members or to prevent any Member from renewing membership if the Member puts Attentive Art and Calm Creative Club into disrepute or if a Member is misusing the Club, its website and/or the Calm Creative Club Facebook Group. Membership can also be terminated if a Member is deemed to be abusive or prejudiced towards another Member or Members.

If a Member wishes to terminate their Membership, they may do so at any time by logging into their account and cancelling their subscription plan. They can do this at any time, but Attentive Art will be unable to refund any money which has already come out of that months payment, the subscription payment will stop the month after if the subscription has been cancelled mid month.

If a membership is terminated and the member wishes to reinstate their membership then this will be at new terms and at a higher monthly rate if fees have increased.

Members Area

Members can create their own personal login and password details to enter the Calm Creative Club. Within Calm Creative Club, Members will have access to materials (audio, visual and written) by Sophie Walker. The distribution of these outside of Calm Creative Club or for commercial purposes of any sort is not permitted.

Calm Creative Club Members are responsible for maintaining the confidentiality of their membership number, login details and passwords, and for all activities that occur under their membership number, login details and passwords, whether by themselves or anyone else using their login details and passwords.

Facebook Group

Members can join a Facebook group exclusively for members of Calm Creative Club. Only people who are paying members of Calm Creative Club may be permitted to join the Facebook Group. Join requests will be approved by Sophie Walker and Attentive Art whose decision will be final. Any Member adding people without permission will be removed from the group.

The Calm Creative Club Facebook Group, although it is a closed group is a public system and as such Sophie Walker and Attentive Art take no responsibility for the views of other members. Any views expressed are those of individuals, and do not necessarily reflect the views or policies of Sophie Walker and Attentive Art.

Sophie Walker and Attentive Art reserve the right to remove without notice any material posted in the Facebook Group that Sophie Walker and Attentive Art deem to be offensive or in any way inappropriate to the nature of the discussion. If you wish to complain about any posts and material in the Facebook Group, please do so within the group or email sophie@theattentiveartist.com

Members of the Calm Creative Facebook Group agree not to:

Post any material that infringes third party intellectual property rights;

Post any content that is unlawful, harmful, threatening, abusive or otherwise objectionable.

Use the Facebook Group for any commercial purpose or to operate surveys, or contests.

Variation of Terms & Conditions

These terms and conditions may be revised from time to time. If they are revised, we will email the revised version to you. It will be your responsibility to keep up-to date with all such changes and your membership renewal and continued use of the Website shall be deemed acceptance of any changes to these terms and conditions.

Data Protection and Intellectual Property

We will respect the privacy of your data which you supply to us in accordance with our Privacy Policy and forms part of these terms and conditions, and in accordance with the Data Protection Act 1998 and any other applicable data protection legislation. You agree that it is your responsibility to keep your data accurate and up to date and to send us new or revised data where appropriate. You further agree that we may use your data as set out in our Privacy Policy.

It is your responsibility to keep your password/membership number and log-in details confidential and use the security devices offered. Our security measures depend on you complying with this obligation and we are not responsible for any breach of your privacy due to your failure either to keep your password/membership number secure or to use the other security devices correctly.

You acknowledge that the internet is not a completely secure medium, and we therefore cannot be responsible for breaches of security arising out of intentional and/or unauthorised attempts to access the Site, for example, by computer hackers. In addition, we are not responsible for the use made of your personal data by other Members who access it through the Site.

Governing Law

These terms and conditions shall be interpreted in accordance with English law and all disputes shall be subject to the exclusive jurisdiction of the English Courts.
